1. Acceptance of Terms

By downloading, installing, or using the Dear Diary mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App. Continued use after changes constitutes acceptance.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the App, nor reverse-engineer or attempt to extract the source code.

3. Your Account & Content

All journal entries, mood logs, and other content you create in the App ("Your Content") are owned entirely by you.

You are solely responsible for Your Content and for ensuring that it complies with applicable law.

We do not claim any ownership over Your Content. Since data is stored locally on your device, we do not access or transmit it.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

You agree not to use the App to store or transmit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

You agree not to attempt to interfere with, hack, or compromise the security of the App.

5. Intellectual Property

The App, including its design, features, text, graphics, and code (excluding Your Content), is owned by Dear Diary and protected by applicable intellectual property laws.

"Dear Diary" and associated logos are trademarks of Dear Diary. You may not use our trademarks without prior written consent.

6. In-App Purchases & Subscriptions

The App may offer premium features via one-time purchases or recurring subscriptions, processed through the App Store or Google Play.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your device's account settings.

We do not offer refunds for partial subscription periods, except where required by applicable law.

7. Disclaimers & Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, Dear Diary shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

8. Data Loss

Since your data is stored locally on your device, we strongly recommend using the built-in backup features or enabling optional cloud sync to prevent data loss.

Dear Diary is not responsible for data loss resulting from device failure, uninstallation, or other circumstances outside our control.

9. Termination

You may stop using the App at any time by uninstalling it.

We reserve the right to terminate or suspend access to the App for violations of these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.
